In light of recent judgments by the Court of Protection, the Office of the Public Guardian for England and Wales has updated its legal guidance for professional deputies and attorneys on making gifts of a protected person's property.
The new guidance contained in Public Guardian practice note PN7 doesn’t contain any new rules but does clarify the position and confirms that the power to make gifts by an attorney or a deputy is very limited.
